What is Consent to Establish (CTE)?

Industries must first get the Consent to Establish certificate before beginning the installation or building of any machinery, plants, or manufacturing activities. It guarantees that your proposed industrial operation will not negatively impact the local ecosystem and will adhere to the established environmental regulations.


The Water and Air (Prevention and Control of Pollution) Acts of 1974 and 1981, respectively, provide for CTE.


When Do You Need CTE?

You need to apply for CTE:

  • Before starting the construction of any industrial facility.

  • When expanding or modifying existing industrial setups.

  • When setting up new pollution-generating processes.

This applies across all categories: Red, Orange, Green, and White, with the Red category industries requiring the most stringent scrutiny.

CTE vs. CTO – What’s the Difference?

After obtaining CTE, an industry must also obtain a Consent to Operate (CTO) before starting actual operations.

Obtained before construction begins

Obtained before commercial production begins

Validates your proposed plant design

Validates your operational activities

Regulates pollution prevention at the design stage

Monitors ongoing pollution control practices

Both are crucial. Without CTE, you can't legally start construction. Without a CTO, your operations are unauthorized.

How to Apply for the Pollution Control Board's CTE Program

The application procedure includes the following:

  1. Classification of Industry: Based on pollution load (Red, Orange, Green, White).

  2. Document Preparation:

    • Site plan/layout

    • Project report

    • Land ownership documents

    • Effluent & emission control plans

    • EIA report (if applicable)

  3. Online Submission on the respective State Pollution Control Board portal (e.g., CTE/CTO MPCB for Maharashtra).

  4. Fee Payment: Based on industry size and category.

  5. Inspection & Review: Field visit by PCB officers.

  6. Approval or Query: Consent granted or clarifications requested.

Why It's Critical to Comply

Not obtaining the appropriate CTE and CTO clearances may result in:

  • Fines and penalties

  • Shutdown notices

  • Legal action from regulatory authorities

  • Rejection of future environmental clearances


The Maharashtra Pollution Control Board (MPCB) and other agencies are enforcing non-compliance more strictly, especially against facilities that emit a lot of pollutants.


Final Thought

Building a manufacturing facility, a chemical processing plant, or a storage facility does not exempt you from getting the Pollution Control Board's Consent to Establish. Making sure your company is environmentally conscious from the beginning is more important than merely following the law. To begin production legally, obtaining your Consent to Operate certificate is just as important as obtaining your CTE.
